There is 'fair dealing' in the UK, which basically relates to using excerpts of a piece for review, criticism or news.

Make the hirer provide insurance? That's how it generally works, you ask for a copy of their policy certificate and it's up to them to sort out if they break your kit.

Is the sound clipping, or is it compression artefacting? If the latter, look at the audio bitrate which is separate from the video bitrate. 30fps ought to be irrelevant.
