ASK & DISCUSS
INDEXAgreement 3D artist for shopping material (or more, maybe)

I'm in discussion with an architect to render a (couple of) spaceship(s) for the scifi I have mentioned to you guys a number of times. I'd like to make things right, so with an agreement before he does any work. What would be appropriate? A mix of a Copyright waiver and a Footage license? Any points specific 3D art I should insert? Thanks....
The idea would be that he'd use this to get other jobs, and I'd use this to illustrate the project for relevant producers. It may or may not be that the work will be integrated in the feature when it does get made, and the one should not jeopardize the other.
And it may be that I work with him on the action feature, a scifi short or other projects later.
Looking forward to seeing the ships!

IP law is complex and vague, so agreeing what happens in the worst case scenarios and writing and signing is probably most productive.
Are you paying actual cash? My suggestion would be for you to be assigned all rights, but for him to retain a licence if he's building it from scratch. If he's adapting/extending someone else's model, you'll need to be aware of the rights restrictions on that and its underlying models too.

Paddy, thanks for being there.
Currently I'm still unable to pay any cash unfortunately. Yes I did give descriptions, written and verbal, and a couple of my drawings and the colors to work with. I'm not sure what to restrict.

Maybe just sit down and make an agreement with him that you can use (hand a licence for) the footage for promotional use, but that he'll retain all rights, and if use and display of the footage means you get finance for the film eventually, you'll have the option to buy that copyright for €x,000 and he'll have the option of a creative role in the project? It's not terribly neat, but it's pretty equitable and you can ratify it with a short, plain language letter

This is where things get opaque for me: how many (not Euros :) ) CHF are right, and how to make sure that an option on his side to get a creative role doesn't make convincing a relevant producer harder than it already very much is?
Note that I will definitely not be the producer of this large feature. No doubt about that. It's good to be certain of some things in life.

There's no 'right', there's only what you agree. In moviemaking terms (particularly for larger budget scifi) though a couple of thousand Euros/CHF is going to be something you could pay out of your writing fee if nothing else, so not a big deal. Clearly you cannot guarantee a core creative job on his own terms, but you could dangle a carrot about maybe becoming an art department advisor or similar - committing no dates or fees.
