Do you need a National Insurance Number for a child if they're working for you as a minor and receiving payment?

This is also something which has come up on our contract regarding becoming her agent so same thing again, in that respect, really. I've read in some places that you can phone up and request the NI numbers early but I've just spent hours on the phone with HMRC, DWP, Inland Revenue, Tax offices, Citizens Advice, Job Centre, and they all say that she's too young (aged 11). If so, is there an alternative she needs?

Under 16's don't have NI. Anyone under 16 can have a tax liability and therefore a tax reference. You can register them for tax, and their gaurdian or agent would have a mandate to sign that on their behalf each tax year.

Just copy links to HMRC statements etc re no NI for under 16's to anyone giving you a problem. Production companies etc do have to deduct NI from payments to actors, but I'm guessing if no NI is allowed they would be covered.

Tax can be paid by anyone earning over the annual thresholds regardless of age. It's just that they can't legally sign the return.

I think the issue is that National Insurance isn't a tax, but a system of insurance to which you cannot contribute UNTIL you are 16. Since the child will not gain any benefits, they need not make any payments and hence cannot have an NI number.

If it's a third party who thinks she should have an NI number then probably the only way to deal with the issue is for the child to write to the NI people stating her position and asking for EITHER an N I number OR a letter confirming that she can't have one. Then show this to whoever.
