INDEXEmployers liability cover for filmmaking, if crew are not PAYE
12 years, 3 months ago - shirley day
Hi, I run a registered charity, we want to make a film. The crew we will use will not be PAYE. They will be self employed. As such my insurance company tell me they are not covered by employers liability cover and must have their own insurance. Can anyone recommend an insurance company that covers people working for you who are self employed.
Thanks

I have public liability and employers insurance through Performance Film & Media - I have the latter specifically because I employ freelancers (so I trust it does cover them!) - I would check them out: https://www.performance-insurance.tv

Have a look at Aon insurance too. If Paul Cable is still with them, he was very helpful for start up insurance for m first film.
Good luck with it,

Here are a couple of sources: http://www.bectu.org.uk/benefits-services/pli

If your crew are BECTU members, they will have their own liability insurance which is part of your BECTU membership. Don't be afraid to contact BECTU, getting the union involved does not mean they will cause you trouble. They are there to help. The benefits for production having union members on-board is the expertise and health & safety that they bring with them. As well as their own insurance! :)

A lot of freelancers, even if not BECTU members, may have their own insurance cover. I certainly did when I was freelancing. Maybe worth just asking the question to the crew before you go and spend money from the budget on insurance you may not need. However, as Howard mentioned, it could be worth speaking with the union if a lot don't have cover.

HI Bill, Volunteers are covered by the public liability. It's the actual employment part that is difficult. Self - employed people seem to be classified as contractors and are expected to have their own insurance. I don't think people always realise this. Performance Media seem to be able to insure the self employed crew, and I will certainly try the other brokers listed here. Thank you everyone for your help and comments

Freelancers are often self-employed which means they sometimes subcontract or hire staff and therefore require employers and public liabilty (they normally come together as a package).
HOWEVER, just because some of your heads of department have their own liability insurance does not mean the production company is covered. Liability insurance is a legal requirement. Your best bet is to speak to an insurance broker to get a policy which will cover the self employed workers you contract (reading between the lines it seems not all your self-employed workers have insurance and thus you need a policy to cover them).
By the way, BECTU membership does not automatically confer liability insurance - the crew in question need to sign up for it an pay an extra fee and not all BECTU members do this.

I recommend Essex Insurance Brokers. As a broker, they will trawl the market and find you the cheapest insurance policy to suit you. Performance were quite expensive last time I checked.

I woukld talk to a couple of different insurers. This doesn't sound right to me. As i understand it, even if people volunteer to work with you, you must have EL insurance. Shop around!
