Guerilla filming in a fast food restaurant.... any words of caution or legalities?

Am prepping scenes to be conducted in a fast food restaurant. The cast are all mine but am sure the restaurant(s) we're going to target will be relatively busy when filming. I will obviously blur all faces in the finished footage but legally, where do I stand whilst conducting the filming?

Any advice on this is very welcome.

Have a backup plan - if they ask you to leave, do so, fast and humbly. Then maybe set up elsewhere for your second option ;-)

As for using the footage in your film, you may be tiptoeing right into libellous territory depending on the tone of your film, so make darn sure you've got decent professional indemnity and that the insurers are aware of the nature of the piece.

I agree with John. You're trying to conduct your business on their property, and the impression I get is that you haven't sought permission from the business.

If the restaurant is on board, you should be okay be placing signs on the main entry to the restaurant, advising patrons that a film/documentary is being filmed that evening, and that by entering they are granting permission to be used. I saw this on my local chicken shop that was featured on Channel Four's recent fly on the wall documentary. I would even advise advance notice in written form so potential patrons early on know what is happening.

Remember health and safety issues: even with permission you will be laible for any injury, damage etc. Do a proper H&S assessment (covering you, crew, public, staff), make sure that your insurance is not compromised/invalidated. Remember too that a shop is private property: if you are asked to leave and don't you will be guilty of trespass.

Hi,

Main thing I would do is get signed consent/location release forms from the restaurant, partly warn people verbby just they know where you going to be had samiliar issues on shoot a few weeks ago. (railway station based)

Thanks Paddy and Chris for your answers, much appreciated. The insurance issue you both raised is taken on board... and I do have a back up plan as well. Hopefully filming can start by the end of March.

Hi Gentlemen,

Firstly, thanks for your replies so quick. Yes, Nick, you're right in your impression, it's a hidden camera piece for a documentary on obesity. The set up is a little similar to Super Size Me.... the only difference is that we have a Barbershop Quartet in-situ.... long story... short visual 'gag'....
