INDEXLicensing Stock Footage?
11 years, 5 months ago - Ian Endfield
Hello All,
Hoping everyone has had a fruitful beginning to 2014 so far.
I am currently shooting an interview series for a Boxing channel and we have been given exclusive access to film boxers at gyms for B-Roll.
Does anyone know how I could possibly license this footage to an archive or sell it? This is under the presumption that as the photographer of the footage and the show's format I own the rights to it?
Any input and questions welcome!
Thanks,
Ian

It can never hurt to get everything released. Agencies will need to be confident they're not getting into a world of hurt by taking you on, and having a huge pile of paper will help.
The written agreement is a contract - rather a contract is an agreement, the written confirmation is there so both sides remember it. Plain language is fine - lawyerese is a language lawyers like to keep them in business. Large swathes of the top-end motorsport industry went over to 'plain language' contracts many years back, it's a good idea.
Strictly speaking for a contract there needs to be an exchange, so offering a fee of £1 in the agreement will satisfy that.

Thank you Yen! I thought that might be the case. There isn't actually a contract per se but a written agreement. We have a good relationship with the channel so I think if I just asked they would be ok, they have given us a lot of freedom so far. We have the release forms so far for those who appear in the episode but not locations (the series is filmed primarily in a black cab). However we do go inside gyms where the boxers train for b-roll... is it best we go back to the gyms and get a release signed for the location? It's usually a case of getting there and everyone is fine with it...

Hi Ian,
First you need to get release forms for the venue and each boxer featured. Presumably you will have this for the film, but keep copies.
If you are filming for a company, or a specific film and getting paid for it, you need to clear your right to use the footage yourself. That will depend on your relationship, but you could offer to only use footage not used in by the company. Look at your contract with the channel and see what that says. If it does not say that they have the rights to everything, you might get away with just selling/licensing the shots on, but I would definitely stick with shots not used etc.
Then get in touch with a stock footage company. These have lots of stock, and are always looking for more

but there are many others. They will tell you what format they want.
Good luck with it all,
