Using watermarked archive footage

Hey there! I was wondering if anyone can help me navigate this.

I've edited a short video-art piece making use of some actuality footage from the Associated Press archive. Now, for how the piece works, the AP watermark would feature - it is part of the point the piece is trying to make.

That footage - low-res with the watermark - is free to download. My question is, do I need a licence from AP to use that? I know that to download the high-res version I need a licencing plan. Yet, I am happy with the low-fi look. I tried to look at the licencing FAQ on the AP website but this option is (obviously) not even considered.

That said, there is also the ethical question, for which I feel like I should get a licence no matter what. But I would like to know how I stand on this, if only to negotiate a better deal for this completely self-funded zero budget art piece.

Does the watermarked version come with a license? If so then the answer's in the license, if not then well, you don't have a license. At least that's the legalistic answer. Whether it matters or not depends on what you'll be doing with your work, your personal ethics etc.
