What are the licensing implications of using a short clip video of a group singing a famous song?

Hi!

I am currently in the edit on a short documentary about the rise of an up and coming band based in Brighton. It is an independent film we are hoping to submit to festivals.

We have a short clip that was shot on a phone of a group of the guys playing a piano and singing Wonderwall by Oasis in a train station, and want to find out the implications of using this. It was unplanned and a bit spur-of the moment, and therefore not a note-for-note cover.

Would this affect how we can use it?

Any help would be really appreciated!

As you will not be using the original recording / artist, you don't need performance rights, but you do need to consider the publishing rights for the music / lyrics.

Your best option is to ask Oasis. If they agree, you're all good. Send them the film so they understand the context.

Possible side effect - they like the band and choose to help them somehow.
