Does a production cover a driving fine incurred while driving for the production?

Hi All,

So recently I was working on a production wherein I had to rent a van with my own credit card. While driving, I accidentally entered a no entry zone and I got a fine, which was charged to my credit card.
I would’ve thought that the production’s insurance would have covered it, but the producer seems reluctant to do so. Can anyone help me out? It was my mistake of course but it seems crazy that I should have to pay out of my own pocket when there are insurances in place for this on film productions. It’s only a small fee (less than £50), but as I am a trainee and living on benefits at the moment, I really can’t afford the fee...

I doubt there's insurance against a traffic offence. There may be insurance that provides legal assistance but the prospects for success must be weak.

There's lots of precedent that the driver is liable for any offence they commit. Any credible defence would have to rely on an argument within the Common Law catchment of 'Duress of Circumstance' such as 'a lunatic held a gun to my head and made me do it'.

The Producer can choose to cover the fine, but they certainly don't have to. They didn't ask you to enter the no entry zone.

For the sake of 50 quid, if they don't settle, you'll not be helping them out again I guess.

It would not be an insurance matter.

Plenty of driving law is absolute - if that van had been uninsured and you got caught, YOU would have been prosecuted, not the van company. (You might then of course have a civil claim against them, but that would be a separate matter).
